5.2.2 Deposition

The forensic expert is a professional who should be paid for services rendered at the time or before such services. It is always best to receive written assurances as to the amount of payment prior to agreeing to a deposition. If there is no written commemoration of payment, a discussion regarding how to resolve the matter should be conducted while the court reporter is inscribing the conversation.

The forensic expert should also discuss the predeposition fees with the retaining attorney. The forensic expert needs to be prepared for the testimony and needs to keep the attorney informed as to the costs to prepare.

Additionally, different jurisdictions have different rules and procedures as to the costs of travel to and from depositions. Again, this should be discussed with the retaining attorney prior to the deposition.
